These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Kingdom, Hong Kong, and South Africa, as applicable.

3. Limitation of Liability and Warranty Disclaimers

a. Limitation of Liability: In no event shall Checks & Traces, its affiliates, directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, project delays, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Services or these Terms.

b. Warranty Disclaimers: The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Checks & Traces makes no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Your use of the Services is at your own risk.

4. Intellectual Property Rights

a. All intellectual property rights in the Services, including but not limited to copyright, trademarks, patents, and trade secrets, are owned by Checks & Traces or its licensors. You shall not acquire any ownership rights to the Services or any intellectual property rights therein.

5. User Restrictions

a. You agree not to:

i. Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.

ii. Modify, adapt, or hack the Services or modify another website so as to falsely imply that it is associated with Checks & Traces.

iii. Attempt to gain unauthorised access to any portion or feature of the Services, or any other systems or networks connected to the Services, through hacking, password mining, or any other means.

iv. Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.

v. Transmit any viruses, worms, defects, Trojan horses, or other destructive items through the Services.

vi. Reproduce, white-lable, or remove our branding in an attempt to pass off the information collected in our Services as your own work. 

vii. With regard to the Cyber Health Check, conduct this service on any person other than yourself as the purchaser. 

viii. With regard to the array of Background Checks, conduct these services on anyone other than a person whom you have the intention of hiring. 

ix. With regard to the Remote Romantic Partner Background Check, conduct this service on anyone with whom you are not in a remote romantic relationship. 

6. Right to Termination

a. Should you breach any of the user restrictions contained in paragraph 5, regardless of the type or materiality of the breach, we reserve the right to terminate or suspend your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. Upon termination of your access, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

b. In the event of termination for breach of the user restrictions, no money already paid to us by you will be returned. 

7. Modification of Terms

We reserve the right to modify, update, or replace these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Services after any such modifications constitutes your acceptance of the revised Terms. Therefore, we encourage you to review these Terms periodically for updates.
